BOB YEZEK, Thermoptic, My friend I think nyou have never been manhandled by paypal that is why you are saying this. Yes, paypal manhnadles its customers by blocking there accounts needlessly and ask them to fax papers again and again and still after that they are not satisfied and start making baseless allegations that our paypal account has links witht some other account of which we might haven't ever hear dof or communicated with. This is all just to harass it s consumers and show their power on poor customers. When you want to have yourself robbed or have too much money to handle just receive some money in paypal and rest paypal will take care of, freeze your account, harass by asking you to fax papers again and again, after that gobble up your money. I think paypal's employees when sit and have tea break they think of having some fun and to enjoy that fun they block someone's account and ask papers fomr him. And in the email they say that they are doing as trhey have concerns for paypal's security and integrity. WHAT SHIT? Don't the account holders have some rights witht their accounts or are they slaves which can be treated anyway, anytime they like. And they also mention that they apologize for the inconvinience that would be caused due to this action of paypal. To this I think they do not have the slightest idea of how much trouble this causes to the account holders. Even ripping off and tearing off the flesh of the whole paypal team couldn't pay for this inconvinience.

xppman, Just a few weeks till Christmas and I am getting evicted because of this bull with paypal, I have 4000 stuck in my paypal accounts and I have no idea why or what to do, they don't even know what's going on, I asked them why they froze my account, and they said oh it was just a random check! I have two small kids and what a Christmas this will be with no money at all and I dont know where we will go or what to do, I just hope that paypal gets what it deserves.

It is as simple as this :
Paypal are a credit card processor. Nothing more, nothing less. Who gave them the right to pick and choose, which charity your money goes too, just because they process the transaction ?
I think its discusting. I am British and Live in the UK, we saw the devastion of Katrina on Live TV and without a word of a lie we were weeping for our Allies and Brethen in America.
To think that such a pervertion of geneority by paypal is a good thing is riduclous. I do not support Paypal and I refuse to accept monies paid to me through them either.
In fact, if I had my way, they should be investigated by the American FBI.

<Livewire>, I totally agree with the person saying why should we trust a middle man with our money for donations. There are crooks on Ebay & everywhere.
I immediately set up my auctions to automatically take out 20% of my income from several of my large item auctions. I got to pick who the money would go to from a rather long list of charities (not just the red cross) including charities ran locally where the hurricane was hit. I believe this was to make sure when the sellers said they would donate a portion of their income they really would do it. There are so many scammers on Ebay.
I noticed a lot of the Ebay sellers who are anti-Pay Pal are the sellers that sell the counterfeit fakes on their auctions. I am sure they do not want their customers using paypal because Pay Pal has the buyer and seller protection plan for exactly this reason.
I am the first to admit that Pay Pay has some issues to work on and it is not always smooth going, but what is the alternative?? When using paypal you get your money right away, and not have to wait a week for a money order. Some people change their mind about bying if they have to actually leave the house or work to go buy a money order/cashier check. It is inconvient for them, then we have the nonpaying bidders. You know that pay Pal takes a percent of your sell for their fee (they do need to get paid for there service), so just adjust the asking price of the item you are selling. Ebay takes a fee also to list, and I do not see anyone complaining about that.
I have been in several situations as some of the others have written. I have had charge backs, which Pay Pal corrected after an investigation. As a buyer I was charged twice several times, and the seller refused to refund the 2nd payment. Pay Pal investigated and refuned both times. I have received counterfeit items from purchaes on Ebay, the seller of course refused a refund, and I got the refund via Pay Pay protection plan both times that I filed a countereit claim.
Selling on Ebay is very different than holding a regular job, and you need to make adjustments for that. All in all you must be making money or you would be silly to continue to do it.

But a "bank" has a different legal definition. The laws written that apply to a "bank" may or may not apply to paypal.

I don't know either way. I'm just pointing out that there are some people who get themselves into trouble but don't always tell the whole story. I have no idea if this applies to you and your friend or not. Partly because there hasn't been any details given in this discussion.

My assumption is the people that have problems with paypal, it is due to a shortcoming of paypal. However, I've also learned that maybe 30% of the cases, this is not supported by the facts. So a majority of the time, it's people have been snagged by a ridiculous paypal policy or over zealous paypal policy or employee, but there are times when it's not.
I don't know which you fall into, but you do have the benefit of the doubt with me. However, your case would be stronger in my eyes if I had details of what happened.

All I meant by "prove me wrong" is that I would love to see something that I could pass along to my friend in their quest to get their money back. Is a shame that you say "If they truly did nothing wrong file a lawsuit." That is alot easier said than done.
You are the admin of this board and have seen lots of stories like my friends but for some reason you question their honesty and integrity.
No one I know personally will ever use Paypal and I refer all the "why dont you take Paypal" questions to your site.
Maybe one day someones integrity will not be questioned because they are being told by highly educated people on this issue that Paypal is not held to the same standards as a "real" financial institution. As is plainly spelled out, paypal settled to spare dragging their name through the mud.

The problem is you are not familiar with the law and how it works. Words are given meaning based on the law. The Electronic Funds Transfer Act applies to "finanical institutions." In that act, Western Union is a financial institution within the scope of that law. That same law was applied to paypal in the first (and still only) class action lawsuit. Paypal agreed to pay $9.25 million. They would not pay if the law did not apply to them.

In fact, if your friend participated in the class action lawsuit, they had an excellent chance of getting back their money if in fact they did nothing wrong. Or, they can hire their own attorney and sue paypal if in fact there is a case.
I suspect you may not know the facts of the case, nor the law.
If you have more facts, then post them so we can maybe determine the proper course of action. But for sure, go to a law library and start reading, especially definitions.

I disagree
If Paypal was a financial institution they would be required to follow the rules that apply to them from the Federal Government. Do you honestly believe our criminal government would not enforce their rules on them if they were a financial institution.
Please show me something official that shows they are a financial institution because that means my friends $900 that Paypal is holding is being done ilegally and they should be sued but since they are not required to follow the rules that banks have to follow they can hold the money for 180 days.
My mother is a vice president of a bank and She has confirmed that Paypal is not considered a true financial institution.
Please prove me wrong.............so my friend can get their money back.

Actually you are in error. The EFTA was the basis of the class action lawsuit. It does apply to "financial institutions" as defined in the act. Since the judge Fogel signed off on the case, I think it's pretty well established PayPal is a financial institution, at least one definition.

That proves your knowledge related to this issue. Paypal can freeze accounts at will on trumped on charges and hold the money for 180 days with no recourse for the sub account holder(Paypal is the real account holder, you are just a signer).
Banks are NOT allowed to do this. They are also not allowed to freeze funds without something called PROOF which Paypal cannot produce in 99.9999% of the cases they claim fraud in.
You really need to read up on the facts before you start making statements that are totally false.

If so, contact your Attorney General Mike Hatch. He takes NO crap when it comes to dealing with companies that mess with consumers. And along with your individual AG's, send complaints to PayPal's AG and the FTC.
By the way, I'm sure that most here know this, but eBay and PayPal are the same company.
I haven't had any problems with them as of yet, but this forum has driven me to take actions about getting my own merchant aco****...
*** To the person below whose credit report PayPal pulled- that's illegal for them to pull it unless you have a line of credit/credit card and you signed an agreement with them. It's a Federal violation of the FCRA for a company to pull a consumer's credit without cause. It's called permissible purpose. Your state may have accompanying laws as well. ***

Bah. Couldn't we sue PayPal for doing this? Isn't it a crime that they have commited? I thought that stealing is where you take someones money and so they don't have access to it. There fricking terms and condition probably protect them against meteorites, but hey, some noble payment processors DO allow for people to get on with life.
Oh and Hi PayPal. Im sure you monitor this website just in case you can sue us or do something. Hey, why not link to us from your site?
