Wrong, paypal does protect the seller, if the seller follows the seller protection policy. No they won't automatically take it from your bank.
You would just get charged off to collections until you pay the debt off.

is it true that if the buyer paid through e-Check, they cannot file a chargeback?
Last month i saw a dvd on ebay and the buyer is from UK. I didn't realize the shipping fees to UK is $50CAD until i mail it. So i just ship it with regular airmail with no tracking number. I've been shipping my dvds out by regular mail with no tracking number and there was no problem at all. Until now, the buyer filed a claim to paypal that she never received the item and wants a refund.
Paypal left me with only 3 options: 1)issue a refund. 2)provide tracking information. 3)prove that i already given a refund.
Paypal does NOT protect the seller any way which SUCKS big time! Now i'm stuck with no option to choose from. Luckily i already withdraw the money once the eCheck has been cleared into my paypal account. SO now my paypal account is $0.
Now my question is, when paypal withdraw $$ from my account to give a refund to the buyer, it would show a negative balance in my account, would paypal automatically take money away from my bank account?? This is the thing that worry me the most. Or would paypal just shuts down my paypal account then??
Hopefully someone can give me some advices!

The thing we suggest is that you follow our golden rules for sellers who use paypal at our website, and do not link your paypal account to your ebay account. keep everything separate and send out emails with the payment link in it. go around and and find other payment methods, such as checks money orders (which you put a holding time on) so that you can cut down on the number of transactions that go into paypal. people who pay via check or money order cant file chargebacks!

I was selling on eBay, and PayPal is not really fighting chargebacks, but they are really scared of chargebacks. And if it happens, PayPal will surely close the account of the Seller! I was the seller and I didn't do anything wrong. Someone bought product from me, and he/she said that he already got the product. A while later, the payment was charged back and they think that it was my fault! I bet the buyer is laughing silly because they claim that they did not issue the payment, when they actually did. My account was also frozen because of 1% of disputes. Which PayPal did not mention what was the problem with my account, and that I was willing to do what it takes to get my PayPal account running again... after waiting for a reply for 5-6 days, all they said was 'the decision is final and they are closing my account'. So that means they didn't tell me what was the problem and I couldn't do anything about it. My friend who was selling on eBay also had the same problem. PayPal definitely suck big time, because they just shut anyone's business without giving a good reason or alternative. You just hit a wall that you can't do business anymore.

It sounds like they tried to do something with that laptop that they wound up breaking the item, then tried to hide the fact they broke the item and then tried to put the blame on you. I'd take pictures of the item & take the pictures that were from the auction.
IC Systems isnt going to do anything whatsoever or do anything to your credit report because they cant. PayPal hired them to try to muscle you into paying for something you dont owe. (1) PayPal was the one that charged your credit card so they are the ones that are legally responsible for the chargeback not you (2) you prove that the buyer destroyed the item with the pictures and I'd just send the item back to her without her knowledge and place a fake return address on the label so that if she tries to refuse delivery it will just wiend up back to her. (3) IC and PayPal have to prove that the debt is owed which it isnt as long as you can backup your statments. (4) create a non contact letter (see our website) stating dont call me every again basically and everything goes to writing which gives you 30 days to respond to a letter. (5) your next paypal account just get an alternate address, so that if they limit your account again you can basically just ignorne the letters.
After a while the letters will stop for the reason that it takes too much money for IC to pursue and they know they arent getting a dime from you. I've had people that PayPal tried to go after them for a few thousand, after a while it just stopped.

I was in a similar situation last year that still isn't resolved. I sold a Dell laptop computer last May to a lady in Texas. The unit was in fine working condition to the best of my knowledge (meaning I KNEW it worked when I mailed it off, but it was a couple of years old, so I gave no warranty on it. I received payment through paypal for $315 + %15 shipping, $330 total. I left the money in my paypal account for a week after the buyer received it, which is what I normally do in case of a dispute. The buyer got the computer, left me positive feedback and had it for over 1 month & then all of the sudden, I get an email from paypal telling me I needed to correct my negative balance. Turns out after having the unit for over a month she decided to file a SNAD (significantly not as described) claim on me & did a CC charge back for the $330. I, of course, disputed the SNAD claim & presented all of the evidence I had (i.e. good feedback left, length of time she had the item ect.) and I REALLY thought I had the whole thng won & low & behold, I get a response from the PP dispute dept that they had ruled in HER favor & I owe PP $330! The b uyer did actually send the item back in much different condition that when it was sent. It had scuffs on the case like they threw it down the stairs or something & it came back with a totally different AC adapter and a fried motherboard. essentially a very large paper weight. My theory is somehow or other she fried this thing after having it for awhile & someone told her to do the chargeback & it worked in her favor. I tried to present this evidence to Paypal after I got the item back but they ttold me "case closed" and didn't want to hear anything about it. It was easier for Paypal to get the money out of me (which they haven't yet) than to fight the CC company. Now I have a place called IC systems calling me every day trying to collect, which I will eventually pay since they are also reporting to the credit bereau any making my credit worse than it already is. Sad part is I was a Premier verified customer with them, having been a PP and ebay member since 1998 with a 121 ebay feedback and while not a "power seller" I have paid a couple of thousand in fees to paypal over the years. Saddest of all, the buyer was a total newby with a (1) feedback rating and an unverified paypal account. Sorry for the long post, but I just want everyone to know if it can happen to me it can happen to anyone.

Anyone who's a seller has to follow our Golden Rules For Sellers Who Use PayPal on our website. The very first thing it states, is that you should never ship a product out until the funds are physically in your bank account. Just before someone submits payment via PayPal into your PayPal account, IT DOES NOT MEAN YOUR PAID, you are paid when those funds are in your physical possession. From the time you withdraw the funds and the time it takes to get into your bank account, those funds are in a pending mode. While the funds are being transfered or if the funds are in your PP account, PayPal has 100% control of the money. Your not paid. You never want to be kept in a situation where your out both the funds and the product. If you dont wait until the funds are in your bank account and you do ship the product out, you set yourself up for that same exact case scenario.
As far as PayPal wanting to see all that information, its none of their business, there's something called a Privacy Act which makes it illegal for them to do so. There's alot of ways to get around PayPal, trust me we've used them for the past 5 years and it works.
PayPal is only after their own interests and will ask you for any information to stall you, make you forget about the money. If they are asking you to provide that proof, they are basically accusing you of selling stolen merchandise. Get them to admit it and you can sue them for defermation of character and slander/liable.
Cougar there's alot of information you can use against PayPal at our website. The key words are FTC and lawsuit. When you call PayPal be prepared to get the run around, being transferred to department after department and hearing the same thing. Just be warned.

2guysgames, Hi there, I am in the same situation right now, going through the exact same thing and can't seem to do anything about it. I am a college student who supports her family and puts herself through school and now I am out of hundreds of dollars (as a seller) because paypal has frozen my accounts even after I've provided them with most of the stuff they asked event he shipping confirmation. Now they are asking me for information about my supplier and I'm thinking "whats it their business??" I am in tears here because I have a lot more listings ending soon and everything is frozen. Please let me know how your lawsuit and if you can give any feedback or advise. I would love to sue those scrupulous people! They have no idea what this does to people such as myself who are depending on the money! Thank you so much and God bless.

I for one am actually glad that PP does not fight chargebacks.
I bought a $4,000 TV using PP and never received it.
I filed a dispute, and even though PP ruled in my favor, they said the seller does not have any money in his account so they can’t do anything about it and closed the case.
Fortunately, I used my credit card so I filed for a chargeback. One week later, needless to say, I got my money back. I guess there was something PP could do after all.
All I can say is thank god for creditcard chargeback policy. With out it, I would have been out of $4,000.

We recently decided against my objections to use paypal and start selling our product on ebay.The first week we sold 12 items for 1200.00 the next week we sold 11 for almost 1200.00. we have almost 1700.00 sitting in our account at this time. they have asked us to provide proof of shipping we complied they wanted [proof we had the stock to cover what we sold we complied.. they came back at us and said wed have to wait until the items were shown as deleivered we complied.. their" investigation" stated they felt we were an unsafe risk and were not only closing our paypal but our ebay accoutns as well and were going to hold our money for 180 days.
we are not sitting on this we are contacting our state attorney generals office tomorrow we are filing a complaint with the better business bureau here in North carolina we are going to file a lawsuit agaist paypal for each and every transaction they have denied us access to our money from. and no we are not going to file in santa clara california as they claim we have to do and no we are not going to just ask for our 1700.00 we are going to ake them pay for wach and every item they denied our money from and on top of that we are going to ask for punitive damages for the ost revenue and lost intrest that paypal and ebay have denied us...
oh and when calling the "customer service" we mentioned that they and ebay were the same company they started yelling saying they were not the same company what a crock....i laughed at them
if anyone knows of an attorney who is involved with a case like this send us their contact info we are going attorney shopping on Tues

It's my opinion that you should file a police report against the buyer for fraud in stealing your car. Also, immediately file a small claims court action against the buyer and paypal (you can even choose one or the other). If you sue Paypal, tell the Judge that Paypal failed to properly investigate the matter and attach a copy of the police report. Before the hearing, serve Paypal with a document demand forcing them to produce information about the investigation they conducted and Interrogatories requesting them to disclose the names of the employees who conducted the investigation. Then SUBPOENA those employees to appear in court (the court can provide you with a form SUBPOENA that the Judge will sign). You can do this Pro Se. Many courts have a Pro Se office to help you. Call your legal aid society. They may provide you with a free lawyer. Also the courts may also provide you with a free lawyer.
