I sold a circuit city store credit(Balance $1940) to a buyer on ebay for $1700 about 2 months back.

I emailed him the card details and pin code

Today i received the chargeback from paypal and my account has negative balance of $ -1780.

I called circuit city and was told that he used it same for two orders and exhausted all the balance. but they would not give me his name or address for privacy concerns.

In the paypal chargeback email which i received the reason mentioned is "unauthorised credit card use" and asked me to fax any documentation i may have.

I sent reply to paypal and also faxed them the invoice email and messages which i sent to buyer using ebay's message system.

Interestingly for reference after the item was sold on ebay, ebay had sent me a message that it violated the gift card policy as it was more than 500$, so the listing was cancelled and all fees were refunded. But that was after the item was already sold and i had emailed the buyer all the information i.e store-credit details etc.

What recourse do you think I would have in this matter. By reading posts in this forum i feel paypal will not help.

Also buyer placed online order using the card informatin which i send him, so circuit city would have the details of wher ethey shipped the order and what is the name of the person.


I am also worried since it would not be covered by seller protection policy and also that ebay had cancelled the listing.

Would going to small claims court help?

Also please note the the payment which i received from paypal had the SAME buyer id as he had on ebay, and also same id was mentioned in the email when ebay sent me an after item was sold.


I would really appreciate your guys help and views as paypal has already made about $450 in my account and would also ask for $1700 which is shown as negative balance or will desstroy my credit history.

i have been selling on ebay for last 5 years and this is the first time i have had a problem like this.

PaypalSucks, I sold a item for $2,5001.00 accepted paypal as payment shipped item to confirmed address a couple of weeks or so later buyer filed despute, nothing wrong with parts shipped. I lost it all item and payment that's doing me no good pay pal ebay fees we keep to the best of my knowlege buyer got it all free then complanined about having to pay shipping cost when I call to find out the problem. They try to blame other partner is the one libial. Pay pal was no help at all. Any suggestions??? I got ripped of by PayPal too...first as a buyer. I bought a jeans and i got shocked when i have recieved them...they were Not As Described! Totally different color...and they were defected - no front top button and a hole in the back. I contacted the seller immediately. He started blaiming "His" wearhouse workers in Turkey;) I saw it's not gonna help and filled a claim to PayPal...Not as described. Didn't hear anything from them in a very long time and got very frustrated. Started sending e-mails to them almost every day and recieved an answer (first one was that my issue has been sold already:))) Lately they have apologized me - system error) - fax third party or dealer signed fax that proves they are not authentic! I called them asking what does it has to do with Not As Described? The "smart" representative was unable to answer. She called supervisor which refused to talk to me. I told her that i had filled the complain previously (Copyed DVD)...and PayPal refunded my money $12 right after i mailed that DVD to them. But this time they want authenticity prooves...idiots. My friends are having problems with limited accounts too. It's like they keep faxing all asked information...but it seems that only blind or weak vision people works at PayPal...they can't see it. Surprisingly there was a lady that told them she can see it very clearly...i guess she was new and didn't know that she should get blind too. They have "limited" more than $2000...for 180 days. People can die... Anyway, some Not Financial Organization acting as one. After all my messages to paypal...my account got limited too:) Good thing is i had only $0.06 there. There is no way i will ever do bussiness with them. I suggest all people to do the same. I filed reports to TrustE already...

The names may be different but the story is always the same...anything from a larger than normal deposit to even one single letter mispelled on a name can red flag your acct and trigger their infamous...."there has been unusual activity" email.."blah blah blah..we must freeze your acct!" Your two options are either sue them, or wait til hell freezes over to get back your funds!
