If you receive an empty box and if it is covered by shipping insurance, file a claim with the shipping service, tell them the article inside the box is lost.

Also, FILE a police report and fax it to paypal at 402-537-5760. And email their escalations dept. at crme@paypal.com

I paid a lawyer $99 to send a letter to them (there are services like this online). I had to do the fax and emails at least 6 times to keep reopening my appeals when a scammer stole $15k from me. Their escalations dept. told me that their "reugular" employees were "accidentally" closing my appeal without really looking at it. 6 times!!!!

This is how I got scammed, and a scammer can do this EVERY time. Scammer sells me something. I pay by paypal. Scammer doesn't send anything, basically forcing me to file a "non-receipt" claim. Seller sees that I filed a non receipt claim and ships and then ships an empty box, which I sign for hoping its what I paid for. Seller then provides tracking number of empty box to paypal. paypal closes the case. I appeal their decision to close the case, but paypal says they have proof of receipt. So I say I need to now file a "not as described" complaint. Paypal then informs me that SINCE I ORIGINALLY FILED A NON-RECEIPT REPORT, UNDER NO CIRCUMSTANCE CAN IT BE CHANGED TO "NOT AS DESCRIBED"!!! This is the genius of paypal. Their system makes you stick with the original complaint. Scam sellers know this loophole and are exploiting it folks, so watch out.

I'm bumping up this old post as it may help those who only read the last few pages of this thread.

Just today, I experienced my first fraudulent activity with eBay and PayPal. I believe there was another time, but the seller stayed in good contact with me, insisted the item was lost in the mail, and refunded half my money. This time, though, there is no question. I received an empty box. The odd thing is that I did not have to sign for it. The person actually spent GBP 16 (or about $30) to send me an empty box from the U.K. with no required signature!

The total sum I sent the seller was just over $951, so nowhere near the loss that some of you experienced, but still a sizeable amount. Fortunately, while I used PayPal, it was a charge through my credit card. I immediately contacted my credit card company (a good one so far!) stating this was fraud. I hope this is one example where PayPal does indeed not fight the charge back!

This was a fraudulent seller. What's really odd is that he has sent me a series of e-mails, some from his supposed account and others through eBay (sent me an invoice). The combination of no required signature and numerous e-mails is quite odd as he can't really prove he sent me anything and I can trace back to him! Furthermore, a bit of investigating showed that I believe this seller has a second account!! So I can track that way too!

But I'm posting because of the lack of help offered from PayPal. As soon as I got this empty box, I knew exactly who it was from as this seller was the only one who would have sent me something from the U.K. with that date. I immediately contacted PayPal via their website. I initially reported that no item was received. It took them about 30 seconds before they closed my dispute stating that it was not filed "properly" per their guidelines and they could do nothing! I then called. The PayPal employee stated that there was no eBay auction listed. When I pointed one out to him, he claimed that he couldn't do anything about it and I should go to a small claims court!! I then filed a fraudulent charge with PayPal. Within minutes they claimed they saw nothing fraudulent and again closed the dispute! In other words, it appears that they want to do nothing. They are enabling this thief to steal nearly $1000 from me and do not want to do anything about it! There is no way they "investigated" my claims that quickly. I fully believe that PayPal is as big a thief as the person who robbed me!

This thread has horror stories about bad buyers, but bad sellers run rampant too! It seems that PayPal should spend the $$ to investigate - but they refuse. One wonders what they are doing with that 2% charge as clearly they don't help customers with it!

While this was my first real complaint with them - it's a big one. After I conclude all remaining auctions, I will refuse to use them again in the future. I'm encountering more and more people who refuse to use PayPal and now I know why.

I have gone to cops and done everything to fight both Ebay and paypal, but the problem is these guys are too big, we must keep all authorities including FBI, your local police, RCMP flouded with calls, and they will eventually get this on the news, this is the last thing Ebay or paypal would want, they always like to hide everything and hide behind their walls, once the public knows everything, the End comes for crooked Ebay inc.

Hi steve00, I'm in exact same situation as yours and I'm having a negative balance of $3500 now. And everybody, especially Admin please check what I just found out ... Sonce I'm a poor student and I do not have the money to pay off the 3500, I called Paypal and talked to one of their representative, I asked her if I can have some payment option so that they will not put me on collection because I keep receiving mails from Paypal threatening that they will put me on collection and I'm afraid of ruining my credit... After a while, she felt sympatizing with me and told me that Paypal is not gonna put me on collection because they are not a credit company, Paypal is just a transferring money company, so I can just pay as soon as I have some money and NO, there will be no collection to hurt my credit, the only consequence will be my paypal account get blocked( which I'm really happy about that) and again, No Collection ( even if they mention collection in their emails) .... I'm not sure about this ... so can you guys brighten me up ?? Thanks guys for this awesome website :)

PaypalSucks, I have what seams to be a mexcian stand off with paypal
I purchased items on paypal, the last 3 payment sent hit my account but I had to shut down my credit card and bank account as they were stolen and I did not want some one to have access to my account.
When the last charges were refused payment by my bank, paypal hit my account with a neg. balance, but the vendor had his account money removed also. Pyapal now wants me to pay them, and the vendor wants me to pay him, Paypal said they removed the funds from his accout becasue of possible unauthorized use.
I told them it was not unauthorized use, and paypal told me to put my new credit cards on the account when I get around to it, that I have 30 days to do it.
I dont want to be charged twice for the same thing. Has any one had this happen to them?

I sold a online game account and the buyer pay with Paypal. After I received payments, I give the buyer the account information. Within half an hour, my account was freeze do to the user disbute. Paypal gone through the resolution center and stated I am in favor. After 4 days, my account was freeze again because the buyer submit a chargeback. and after a month Paypal say i need to pay back the fund I transfer to my bank. Is there anything I can do? Please help.

You are simply blind. I have had my recent bad transaction through Paypal. The buyer is allowed unlimited words/keystrokes, and the seller is allowed 200 KEYSTROKES! Also it is hard to find a way to pursue anything further. HOW CAN YOU HAVE A FAIR SHAKE? Of course I lost my case, and when I finally found a phone number, the response was that buyer was going to get his money back anyway. Even though I sent them his emails, where he bragged that he was going to get his money back from Paypal, and he didn't care whether we even got the item back. Well the buyer sent the item (supposedly damaged by our inappropriate packaging) back uninsured, and this time it WAS damaged (not the damage he claimed), and we have no recourse. It is all bogus.

I sold an Internet Kiosk for $1500 on eBay 4 months ago. Right after the delivery I received a dispute via paypal saying that the item was not as described. 2 weeks later I received a chargeback and my account went negative $1500. I put the money back to make it positive balance because the email was saying it will be disputed if my balance is positive again. Last week I received a chargeback resolution email exactly saying that;

As you know, we have been using the information you provided to dispute
a chargeback filed against the transaction detailed below. Despite our
best efforts, the buyer's credit card company decided in favor of the buyer.

Unfortunately, we do not control the outcome of the chargeback decision
reached by the buyer's issuing bank in a credit card transaction. By
accepting the terms of the PayPal User Agreement, you agreed to accept
the decision of the issuing bank as final and legally binding for this type of
dispute.


I called Paypal and said that I didn`t receive the merchandise back. I also sent an email to buyer but no response yet.

Buyer kept the item and Credit card company decided in buyers favour.

Paypal agent on the phone; Yea, I know you are right but we can`t get involved with this. Go to local authorities..

DeepSouth, I have one to add about paypal fighting chargebacks. I had someone buy items from me, resell them on ebay, get paid for them and receive postitve feedback and then file a claim with paypal stating they sent me back the merchandise because it was not as described. They gave paypal an invalid tracking number and said they sent the merchandise back on Feb 7th. The buyer received 2 packages from me and one didn't arrive until Feb 16th! How in the world they could send items back to me before they even received them is crazy! Even though I clearly proved that the tracking number false and the merchandised hadn't even arrived yet...and gave them the sellers name and links to the items they sold they still refunded them $945.00! They said it was because they claimed the merchandise was not as described. REDICULOUS. They said I should report this person for fraud. HELLO- if they know it is fraud they why did they return the money? Not only did I report this buyer for fraud, but I reported PAYPAL TOO!

PayPal just tries to use intimidation to make you think they'll take actions. If they file on one of them, then they have to file on all of them. And I don't think that have enough attourneys to do that.

I got totally robbed blind by a scam artist recently who outbid 11 bidders on e-Bay to win a coat and then proceeded to send me more and more offensive e-mails that the coat was not any good (all lies!) and he wanted to KEEP the coat and have me give him a full PayPal refund. I refused to refund a dime unless he sent the coat back so I could at least offer it to the Second highest bidder. He filed a "Resolution" case with PayPal and LIED again. The case dragged on for months and finally PayPal slapped ME with a chargeback of over $40.00 PLUS an $11.90 fee to further "investigate the case". I wrote and called PayPal over and over again explained that if this thief was allowed to keep the coat AND the money, I was being robbed. This is totally off the wall! After nearly 3 months, I got a dumb e-mail from PayPal saying (you guessed it) that there was nothing they could do to reverse the chargeback on his credit card back to him. So he has the coat that he has literally stolen from me AND the money PLUS the $11.90 that PayPal stole to "investigate". PayPal needs a class action lawsuit againt their fraudlent practices - they need to be sued from here to the Supreme Court and back again for the lies, cheating and stealing from innocent, honest sellers! The sooner, the better. I am willing to join a class action anytime!

Yep.
I'm glad the admin took the steps to make it where if
YOU want to post get registered.

I'm willing to help anyone but I too grow tired of lazy non registered
posters who want us to do all the work for them to help get their money back.

The Internet and this site is FULL of information to help one do just that.
