I've been reading other merchant credit card services, for the most part, they all state that you the merchant, will receive a letter directly from the credit card company about the chargeback for a discovery of the details of the chargeback and your response.
Yet paypal shields you from attempting any communication directly with the credit card company. I wanted the cc address and telco# so I could contact them directly, paypal says its against their privacy policy.
If the cc company is looking to take the money away from me (not paypal) who is it a privacy issue, I have a right to know the name/address/telco# of the originating compliant company, paypal should have no right to withhold that info, but at the same time demand I pay paypal money against the chargeback, yet I have no way, other then paypals word, that the chargeback is even legit, what the dispute is in detail and whether or not paypal adaquately even tried to defend my side of the case, they refuse to show ANY tangible proof whatsoever.

I had many exchanges with Paypal's Calif. AG's office. And, they weren't able to do much for me either. But, I sued Paypal through my local small claims court. That worked just fine. :)
Perhaps you might consider doing the same...

PaypalSucks, I support this thread. They CLAIM to fight chargebacks but don't. They honoired a chargeback for an item I sold 'As Is' on eBay. Now the buyer not only has the proceeds back due tot he chargeback - but he has the item as well. And so I appealed with a claim at the NE and my states Attorney General's Office. They both seem uneffective - basically doing nothing. My stat AG said that the fact that the item and cash were with the buyer is fraud - eyt it is out of their jurisdiction and nothing they can do.
I have been fighting it for over a year now - and no movement. Probably wrong on my part but I got sick of no support from the AG's I gave in and said okay I'll pay back teh chargeback to you - here's what I can afford to do today. And what did PayPal do - immediately send me to a collection agency demanding full payment.
PayPal makes me sick - they are so discusting in their blatant screwing of the consumer - anyone who ever uses them is taking a huge risk - dancing with the devil.
I have spent months pleadin my case, on the phone, in writing .....
Any ideas on how to get restitution would be great........

If not for Paypal, the buyer's CCC would have contacted you. Made you aware of the buyer's actions, gotten your input, made their decision. If you don't know which CCC the buyer used, you can try to get that info from PP's dispute resolution department. Call them by phone. You might ask for a supervisor. To get info, most of the time, I had to be relentless. Make multiple calls, get info in pieces. Until I had enough to learn something or lucked out. When you call, try pleading your case. Tell them you need to do what is in your best interest. That you have the time to contact and write the CCC. And, can understand how they might be short the manpower that this takes. Emphasize that you JUST NEED to know which company to contact and that you're not asking them to give you an account number. You'll have to put the details in writing for them.
You can file with your local small claims court division against either the CCC or Paypal. You can file against the buyer, if the buyer lives in the same state as you. If the companies are not located in the same state as you, you file an out of state claim. You need to contact your secretary of state's office to learn if the companies have local process agents in your area. Or, check to see if you're state is on this list: http://li-public.fmcsa.dot.gov/LIVIEW/pkg_html.prc_proc_servers?cov_id=3564& If the companies do not have local process agents in your state, you can still file. The companies have to be served through your secretary of state's office, the filing fee is more.

Right now I am in the middle of an ongoing dispute with Paypal because a buyer filed a chargeback for a deposit they paid me after forfeiting it and breeching their agreement to purchase. I had filed a dispute with Paypal and thy ruled in my favor. Then the buyer filed a charge back and Paypal said there was nothing they can do and charged the money to my account. This must be some sort of fraud or theft, this cannot be justifiable. I am at my robes end with this and am looking to seek legal action but don't know where to go. I'm not sure what type of attorney I need for this. Any suggestions??? Thanks

Food for thought, you can sue Paypal in small claims court. No doubt about it, a judge will be a better listner. And one on one, in person, might be easier to convince.

As of right now, I have a 5/17/2007 court date set to sue Paypal in small claims court. Your friend can also sue Paypal in their local small claims court division. If your friend doesn't live in Paypal's city or state, they'll be filing an out of state claim, like I did. For an out of state claim, your friend will need to contact their secretary of state's office to learn whether Paypal has a local process agent. More than likely they do. I won the bid the digital camera around February in Ebay & paid by Paypal / GE Money credit card same afternoon. Same night Ebay Trust & Safety Department emailed me this listing is fraudulent & voided. I called PapyPal / GE Money Credit card toll free number to stop this transaction and filled the fraud form immediately. This whole event happened in the Sunday evening & very early Monday morning a non-banking hour.
This seemed to be an easy operation: just a simple credit card charge back and I just return the worthless manual camera. Instead Ebay/Paypal/GE Money gave me 10 days to prove this was not the camera I bid. Before 10 days was over, Ebay/Paypal/GE Money emailed me since the scammer provided a tracking number from USP and my claimed was voided. Ebay/Paypal/GE Money protected scammer privacy and refused to provide any information about this scammer.
Only response I got from Ebay/Paypal/GE Money, why not keep paying this credit card while we investigated this matters. What happens PayPal credit card ad " 100% secure, 100% traceable"?
I tried Nevada State Attorney, Post Master, Florida Consumer Affair, Police Department FTC and even My Senator Office. Nothings resolved over a year.
My Credit Scores are decling. The collection agency is sending me threaten letter.
Any good consumer attorney ? Any class action against Ebay/Paypal/GE Money is pending?

my friend sold an item on ebay through paypal and lost her entire ebay business and paypal and its the only extra income she had as a disabled person. she sold an item for over a $1000, smartly downloaded the money into her account and took it out of her bank account and paid bills, left $400 in her ebay account for expenses and such, shipped the item, the buyer received it took a part she needed out of the item and then reported it to ebay and paypal as missing a part, returns it and wins her money back even though the seller had evidence with pics and letters that the part was there when shipped, they just picked the buyers side and blew off the seller, froze her account, she was still selling other items at the time to other people and they made payments into paypal and paypal took that money too! and allocated other buyers money to the one buyer that was disatisfied. how can they just take other peoples money after an account is frozen, they just keep sucking up money and screwing the seller. and the whole insane process took zillions of bullshit emails back and forth where they would refuse to answer questions directly, now my friend has a item that has been stolen from essentially and has to be repaired at an expense to be resold and she has lost her total business on ebay by being banned and on paypal by being banned and is being sued by paypal for the cost of the item. She is really ticked off and wants to sue paypal and ebay big time. She has had an ebay business for over ten years that she built up trust with buyers. HOW MANY PEOPLE HAVE SUED PAYPAL? DOES SUEING PAYPAL ACCOMPLISH ANYTHING OR ARE THEY PROTECTED FROM LAWSUITS? HAS ANYONE SUED EBAY? DO THEY HAVE AN OUT FOR BEING SUED?
AND WHO HAS PAYPAL AND EBAYS ACTUAL ADDRESS TO SERVE A LAWSUIT ON THEM? THEY HIDE EVERYTHING ABOUT THEMSELVES IT SEEMS

That's their out. PayPal spends a huge amount of time trying to convince users that they (PayPal) will fight vigorously on their users behalf. They spend several pages on their site making all sorts of general and unspecific claims. But then they put in a notice that says PayPal might not do anything if PayPal doesn't want to.
It was brought up by another user of this site, that PayPal has a financial interest in not disputing claims. The reason is that the merchant banks set the discount rate (what paypal pays to accept visa/mc/discover/amex) based partly on the chargeback ratio. By keeping chargebacks to a min., PayPal enjoys a prefered rate, as the expense of it's users.

<Trish>, the FBI does monitor the IFCC internet fraud...
a seller from yahoo auctions went to jail for a year and had to pay everyone back while on probation so yes the ifcc.fbi is a good thing

I don't know about you but I can't afford to let Paypal allow people to rip me. If I were you, I'd report complaints against Paypal and both buyers with the Internet Fraud complaint center. If your buyers paid by credit card, I don't know if you can bypass Paypal and attempt to deal directly with the credit card companies but if it were me, I'd find out. On your buyer Marcello Fiore, Phonenumber.com reports the address and phone number you show for the buyer as belonging to a business, Carbucks. How were your items shipped? UPS always gets a signature if they deliver to a business. If you haven't called that number, I'd call and ask to speak with the business owner and attempt to do some fact finding. I have no doubt at all about the authenticity of the handbag I sold. And I have copies of everything, receipts-pictures-and all the emails I received from Paypal. Their emails are damning because they repeatedly contradict themselves. I am going to sue them in small claims court. I sold the handbag at a discounted price but I'm going to sue for replacement cost. Where I'm at, the maximum I can sue for in small claims court is $1500.00. I'll file for that and see what the judge allows. I'll let you know the outcome.

Don't you have to love that sellers have to provide proof of receipt by the specific person, but a buyer only has to provide proof of something going into the mail?
"About mid point to my buyers deadline, I received a new email from Paypal. This email informed me that my buyer had been given optional instructions. 1) he could return the bag to me. 2) he could destroy it. 3)he could return it to Paypal to be destroyed."
I question the very legality of destroying property AND siding with the buyer. If they issue a refund, the property should be required to be sent back to the seller. Period. Otherwise they have also issued a judgment that you should be out your property. If this were to go to court, you could probably also seek punitive damages.

I am currently disbuting a chargeback on a item that I sold last year!!! and the buyer says that it is unauthorised. One year?? how can a person do this after one year with this kind of cliam as unauthorised, sounds to me the Ebayer I am dealing with may do it regularly. How can I be liable for this.
I am considering a counter claim and closing my paypal account for good and only accept bank money order checks.
The buyer buys all kinds of different things off Ebay, he bought my EQ and left a positive in may of 05.
